GROUNDS FOR EXEMPTING MINORS FROM CRIMINAL LIABILITY OR PUNISHMENT

This article examines the legal grounds for exempting minors from criminal liability or punishment, the specific legal nature of such exemptions, and the approaches reflected in current national and foreign legislation. It also analyzes the opinions and scholarly contributions of researchers who have studied this issue. Special emphasis is placed on the role of minors’ psychological characteristics, their level of social development, as well as the circumstances and causes of the offense in determining whether a minor may be released from criminal liability.
