PROTECTION OF THE ORIGINAL AUTHOR'S RIGHTS IN DERIVATIVE WORKS CREATED WITH ARTIFICIAL INTELLIGENCE: PROBLEMS AND CIVIL LAW SOLUTIONS
Yulduz Ergasheva ,Abstract
This article analyzes the civil law problems of creating derivative works using objects protected by copyright through generative artificial intelligence models. In particular, mass violations in the AI training process and the incompatibility of the "fair use" doctrine with national legislation are revealed. The research is based on international conventions, US court practice, and the national legislation of the Republic of Uzbekistan. To protect the rights of creators in the digital environment, practical legal proposals have been developed to introduce the "opt-out" mechanism, establish joint and several liability for damages, and implement collective digital licensing levies into the Civil Code and related legal acts.
